These Terms & Conditions ("Terms") form a binding contract between you ("you", "customer") and Folly ("we", "us", "our") when you use our online ordering service, website, or related services.
1. Agreement to Terms
1.1 By placing an order, creating an account, or otherwise using our service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our service.
1.2 You must be at least 18 years of age (or the age of majority in your jurisdiction) to place orders for alcohol, if applicable. You represent that you have legal capacity to enter into this contract.
1.3 These Terms apply in addition to our Privacy Policy and any other policies referenced herein. In the event of conflict, these Terms prevail for contractual matters.
2. Orders and Payment
2.1 Orders are offers to purchase and become binding only when we confirm acceptance (e.g. by order confirmation, or by commencing preparation). We reserve the right to refuse, cancel, or limit orders at our discretion, including due to availability, suspected fraud, or errors.
2.2 Prices displayed are in the currency shown and include applicable taxes (e.g. VAT) unless otherwise stated. We endeavour to ensure accuracy; if an error is discovered, we may cancel the order and refund any payment.
2.3 Payment is required at the time of order. We accept the payment methods shown at checkout. Payment may be pre-authorised; charges are captured when the order is confirmed or despatched.
2.4 If payment fails or is declined, we are not obliged to fulfil the order. You remain responsible for any amounts due.
2.5 You must provide accurate billing, delivery, or pickup details. Incorrect information may result in delays, failed delivery, or additional charges.
2.6 Tips or gratuities, if offered, are voluntary and processed in accordance with our payment provider's terms.
3. Real-Time Updates
3.1 Our menu, prices, availability, and estimated times may be updated in real time. Information displayed when you browse may change before you complete your order. Prices and items are confirmed at checkout; your order confirmation is the binding record.
3.2 Order status (e.g. received, preparing, ready for pickup) may be updated in real time on our website or via notifications. These updates are indicative; slight delays or brief inconsistencies may occur. We are not liable for any impact arising from real-time display delays or technical issues affecting the update feed.
4. Delivery and Pickup
4.1 Estimated delivery or pickup times are indicative only and not guaranteed. Delays may occur due to demand, traffic, weather, or other factors.
4.2 Delivery areas, minimum order values, and delivery fees (if any) are shown at checkout. We may refuse delivery outside our service area.
4.3 You are responsible for being available to receive the order at the designated time and place. If you are not available, we may leave the order in a safe place (where permitted) or return it; in such cases we are not liable for spoilage, and refunds are at our discretion.
4.4 For pickup orders, you must collect within the stated time window. Uncollected orders may be disposed of after a reasonable period. No refund is due for uncollected orders.
4.5 Food is prepared for immediate consumption. Storage, reheating, or consumption outside recommended times is at your own risk.
5. Allergens and Dietary Requirements
5.1 If you have food allergies, intolerances, or dietary requirements (including religious or ethical), you must inform us clearly when placing your order (e.g. in special requests or notes).
5.2 We provide allergen information for menu items where available, in line with applicable food labelling regulations. Please check product descriptions and contact us if unsure.
5.3 Our kitchen handles multiple allergens. We cannot guarantee that any item is free from any specific allergen. Cross-contamination may occur. If you have a severe or life-threatening allergy, contact us before ordering and do not rely solely on published information.
5.4 You are solely responsible for ensuring that the food you order is suitable for your dietary needs. We are not liable for allergic reactions or adverse effects arising from your consumption of our food.
6. Cancellations and Refunds
6.1 You may cancel an order before we have commenced preparation. Contact us promptly via the contact details provided. Once preparation has started, cancellation may not be possible.
6.2 We may cancel orders due to unavailability, errors, suspected fraud, or other reasons. In such cases we will refund any payment made.
6.3 For incorrect items, quality issues, or non-delivery: notify us within 24 hours (or as soon as reasonably practicable). We may offer a refund, replacement, or partial credit at our discretion, subject to applicable consumer law.
6.4 Refunds are processed to the original payment method and may take several business days depending on your bank or card issuer.
6.5 Where you fail to collect a pickup order or are unavailable for delivery through no fault of ours, we are not obliged to refund.
7. Your Account
7.1 Account registration may be required for certain features. You must provide accurate and complete information and keep it up to date.
7.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
7.3 You must not share your account or allow others to use it. You must notify us immediately of any unauthorised use.
7.4 We may suspend or terminate your account if you breach these Terms, engage in fraud or abuse, or for other legitimate reasons.
8. Acceptable Use
8.1 You agree to use our service only for lawful purposes and in accordance with these Terms. You agree not to:
- Place fraudulent, false, or misleading orders
- Misrepresent your identity or use another person's account or payment details
- Harass, abuse, or threaten our staff, other customers, or third parties
- Use the service in a way that disrupts, overloads, or harms our systems or operations
- Attempt to gain unauthorised access to our systems, data, or networks
- Scrape, copy, or extract data from our website or service without permission
- Use the service for any commercial purpose (e.g. resale) without our prior consent
8.2 Breach of this section may result in account termination, legal action, and reporting to authorities.
9. Intellectual Property
9.1 Our brand, logo, menu, website content, design, and any other materials we provide are our intellectual property or that of our licensors. You may not copy, modify, distribute, or use them without our prior written consent.
9.2 You may view and use our service for personal, non-commercial use only in accordance with these Terms.
10. Limitation of Liability
10.1 To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
- Our total liability for any claim arising from or in connection with an order or use of our service shall not exceed the amount you paid for the relevant order(s) giving rise to the claim.
- We are not liable for: (a) circumstances beyond our reasonable control (including force majeure); (b) your misuse of our service; (c) acts or omissions of third parties (e.g. delivery partners, payment providers); (d) food prepared in accordance with your instructions where you have provided incomplete or incorrect information (e.g. allergies); (e) delays or failures due to your unavailability or incorrect contact details.
10.2 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other matter where exclusion is not permitted by law.
11. Force Majeure
11.1 We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemic, government action, strikes, utility or supplier failure, or technical failures.
12. Consumer Rights
12.1 If you are a consumer, you may have statutory rights that cannot be excluded by contract. These Terms do not affect such rights. For complaints or disputes, you may contact your local consumer protection authority or dispute resolution body.
12.2 In Norway, you may have rights under the Consumer Purchases Act (forbrukerkjøpsloven) and may contact the Consumer Council (Forbrukerrådet) or the Norwegian Consumer Dispute Commission (Forbrukertvistutvalget).
13. Severability
13.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
14. Entire Agreement
14.1 These Terms, together with our Privacy Policy and any order-specific terms, constitute the entire agreement between you and us regarding the service and supersede any prior agreements or understandings.
15. Changes
15.1 We may update these Terms from time to time. The "Last updated" date at the top indicates when changes were last made. Material changes may be notified via email or a notice on our website.
15.2 Continued use of our service after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the service.
16. Governing Law and Jurisdiction
16.1 These Terms are governed by the laws of the jurisdiction in which we operate (and, where applicable, the laws of your country of residence for mandatory consumer protections).
16.2 Any disputes shall be submitted to the courts of the jurisdiction in which we operate, except where mandatory consumer law requires otherwise.
